1. About these terms

These terms of use (the "Terms") are an agreement between you and thruData LLC, a Maryland limited liability company ("thruData," "we," "us" or "our"). They apply to our websites, thrudata.com and ragscape.com (the "Site"), including the Preview sign-up, and to RAGScape, our software. By using the Site or RAGScape, you agree to these Terms. If you don't agree, please don't use them.

If you use the Site or RAGScape for a company or other organization, you confirm that you can accept these Terms for it, and "you" includes that organization.

Our privacy policy explains how we handle personal information.

2. RAGScape and its license

RAGScape is licensed, not sold. When you install it, you accept the RAGScape End User License Agreement (the "EULA"), which sets out what you may do with the software and covers its third-party components. These Terms apply to RAGScape as well. If they conflict with the EULA about the software, the EULA applies.

3. The Preview

RAGScape will first be available as a Preview, a pre-release version. During the Preview, RAGScape is free for personal and business use. Preview software can contain errors, so keep your own backups of important files. Features may change or be removed, and we may end the Preview at any time. Later editions may come with different terms, including paid licenses.

Joining the Preview list on the Site only means we'll email you once, when the Preview is ready.

4. Using our website

You may use the Site to learn about RAGScape and to join the Preview list. Please don't:

• sign up anyone else without their permission;
• try to break into, overload or disrupt the Site, or get around its security;
• use the Site to send spam or anything unlawful or harmful; or
• copy the Site's content or design, except to quote or link to it.

We may change, suspend or take down any part of the Site at any time.

5. AI answers

RAGScape uses AI to answer questions about your documents and email. AI can be wrong or incomplete, even when it cites a source, so check important answers against the cited documents before you rely on them. RAGScape doesn't give legal, financial, tax, medical or other professional advice. You're responsible for the documents you add and for how you use RAGScape's answers.

6. Our content and trademarks

The Site's text, graphics, logos and design belong to thruData or its licensors. RAGScape and thruData are trademarks of thruData LLC. You're welcome to link to the Site and to mention RAGScape by name, but please don't use our logos or suggest that we endorse you without our written permission.

Microsoft, Windows, Outlook, OneDrive, Edge, Word, Excel and PowerPoint are trademarks of the Microsoft group of companies. Google, Gmail, Google Drive and Chrome are trademarks of Google LLC. Other names are trademarks of their owners. We use them only to identify their products, which doesn't mean their owners endorse RAGScape or are affiliated with us.

7. Other companies' services

The Site and RAGScape link to, or work with, services that other companies run, such as Microsoft (for Outlook), Google (for Gmail), Tavily (for web search) and Let's Encrypt (for Remote Access certificates). Their own terms and privacy policies apply to those services, and we aren't responsible for them.

8. No warranties

THE SITE AND RAGSCAPE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT THE LAW ALLOWS, THRUDATA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT PROMISE THAT THE SITE OR RAGSCAPE WILL MEET YOUR NEEDS OR BE AVAILABLE, UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY ANSWER WILL BE CORRECT.

9. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, THRUDATA AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, LICENSORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, BUSINESS OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, RAGSCAPE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.

TO THE FULLEST EXTENT THE LAW ALLOWS, THRUDATA'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, RAGSCAPE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR RAGSCAPE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

THESE LIMITS APPLY WHATEVER THE LEGAL THEORY, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE) AND STRICT LIABILITY, AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Nothing in these Terms limits liability that the law doesn't allow us to limit, such as liability for fraud, or for death or personal injury caused by negligence. Some places don't allow some of these exclusions or limits, so they may not all apply to you. If you're a consumer, you keep any rights you have under the mandatory consumer laws of the place where you live.

10. Governing law and courts

These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict of laws rules. Any dispute arising out of or relating to the Site, RAGScape or these Terms will be decided exclusively by the state courts in Montgomery County, Maryland, or the United States District Court for the District of Maryland, and you and we agree to those courts' personal jurisdiction.

If you're a consumer, this doesn't take away the protection of the mandatory laws of the country where you live. If you live in the European Union or the United Kingdom, you may also bring proceedings in your local courts.

11. Changes and general terms

We may update these Terms. When we do, we'll post the new version on this page and change the date at the top. Changes take effect when posted and don't apply to disputes that arose before then. If you keep using the Site or RAGScape after a change, you accept the updated Terms.

These Terms and, for the software, the EULA are the entire agreement between you and us about the Site and RAGScape. If any part of these Terms is found unenforceable, the rest still applies. If we don't enforce a part right away, we can still enforce it later. You may not transfer these Terms to anyone else. We may transfer them, for example as part of a sale of our business.
